By now automobile and light truck owners throughout Miami and South Florida have heard or read about the problems with airbags that are intended to protect drivers and passengers during traffic accidents. Some airbags have defective components, particularly those used in steering wheel airbags, are prone to explode when the airbag deploys. As a consequence of that explosion there have been reports of serious injuries and even deaths.
These airbags were made by the Takata Corporation in its plants in Mexico. It is a documented fact that the plant produced airbags that failed quality testing at a much higher rate than those produced by its competition. Even though it was aware of this high failure rate, the airbags were still sold to auto manufacturers and installed in millions of vehicles.
About The Takata Corporation
Takata Corporation is a multi-national Japanese company that makes automobile parts, most notably seat belts and airbags. According to court records and data from vehicle safety regulatory agencies, Takata has a history of having its products recalled for safety reasons, including a 1995 recall of about 8 ½ million Japanese models because of reports that their seat belts failed to lock properly. It is much better known for the more recent recall of its airbag safety system.
An ongoing parade of vehicle recalls, as well as a series of federal and state investigations, have revealed that Takata knew it was selling a defective product and then attempted to hide evidence of its negligence.
As of November, 2016 there are a total of 33.8 million vehicles involving 14 different auto and truck manufacturers that have been recalled so that the defective airbags can be replaced. Based on current data, it will take until 2019 complete the necessary recalls and repairs.
While these recalled vehicles are being repaired, there have been at least 14 deaths and more than 100 injuries in the United States alone that were caused by defective airbags. Most of these deaths and injuries have occurred in Honda Civics and Honda Acuras.
Who Can File An Airbag Injury Lawsuit
In order to file a lawsuit for a defective Takata Corporation airbag injury, one of two conditions must be met:
- you must have been injured by an airbag made by the Takata Corporation that had been installed in a vehicle in which you were either the driver or a passenger, or
- you were a driver or a passenger in a vehicle in which a Takata Corporation airbag had been installed and failed to deploy during an accident
Should I Be A Part Of One Of The Class Action Lawsuits Involving A Takata Airbag?
If you suffered a non-fatal injury from an airbag explosion or malfunction, or if a family member was fatally injured by a Takata airbag, you should not agree to the terms of settlement in a class action lawsuit. If you agree to these terms, you will be entitled to an airbag replacement performed by the manufacturer of the vehicle in which the airbag was installed. More importantly, you will lose your legal right to be compensated for any injuries that were caused by a defective airbag. A free airbag replacement is hardly sufficient compensation for an injury that killed a family member or, quite possibly, could have killed you!
You cannot claim a personal injury if there was only the possibility that you could have been injured. If you are the owner of a vehicle in which one of these airbags was installed and it did not malfunction you should probably accept the class action settlement, but be sure to discuss the matter with an attorney because there may be other factors that would allow you to claim additional compensation.
