When a Travis County Sheriff's Office Deputy was flagged down at the Wal-Mart near Parmer Lane and IH 35 on April 26, 2010, at 1:01am in reference to a theft in progress, the deputy turned on the lights and siren of his marked patrol vehicle and headed to the scene. The deputy arrived as the theft suspects exited the parking lot, beginning a chase along Travis County streets.
The deputy duly kept the vehicle in sight and called in his location as they sped through Austin and surrounding streets. When the suspect's vehicle attempted a lane change on the frontage road of Hwy 290 W, between Westgate and Brodie Lane, the driver lost control of the vehicle and slid into a pole.
Four people inside the vehicle were injured in the crash. Two, identified as Eliot Carvajal, 37, and Gary Powell, 20, were treated at the hospital and eventually released. Hiram Espitia, 23, had to be hospitalized in critical condition with life threatening injuries. The fourth, Kenneth Stephen Carter, 37, died in the hospital, reports say.
Carvajal was identified as the driver and has been charged with Intoxication Manslaughter, a 2nd degree felony. He was also charged with Evading Arrest, a 3rd degree felony and is currently in custody.
