Commercial Truck Driver Kills Seven Motorcyclists, Injures Three More

|

A 23-year-old man has been taken into custody and has been charged with seven counts of negligent homicide following a horrific accident involving this young man and 10 motorcyclists on a New Hampshire highway. The now-incarcerated man was driving a truck, with a trailer in tow, over the weekend of June 22 and 23, 2019.

According to preliminary reports from investigators, the man driving the truck who is now facing criminal prosecution was driving eastbound on the highway. The group of 10 bikers were heading westbound.

The investigation is ongoing and a good amount of information has not yet been released to the public by investigators. With that said, preliminary evidence collected from the accident scene suggests that the man driving the truck crossed over the median line and drove into the 10 motorcyclists.

The collision resulted in 7 of the bike riders being killed. Three other bikers were injured. The injured bikers are all on the mend and do not appear to have suffered permanent disabilities from the accident. The truck driver appears to have sustained no significant injuries.

The driver of the truck has a long history of driving-related charges and convictions. These include driving under the influence. At this time, investigators have not confirmed or denied that the driver who was operating the truck was intoxicated at the time of the accident.

The truck driver, who has a commercial license, was on the clock for his employer at the time of the catastrophic accident. The truck being driven by the young man was owned by Westfield Transportation.

Who is Responsible for Deaths and Injuries of Motorcyclists?

As has been noted, the driver of the truck has been charged with 7 counts of negligent homicide and other crimes. The next major question is who shares responsibility for the deaths and injuries arising from the accident. In addition to being prosecuted in criminal court, civil claims for wrongful death and personal injury can be brought against the driver.

Because the driver appears to have been working for the Westfield Transportation Company at the time of the accident, and the truck was owned by that company, Westfield is likely to share responsibility for the deaths, injuries, and other losses arising from the disaster.

The reality is that when a catastrophic accident of this nature occurs involving motorcycles, multiple parties can be at fault. In addition to the two parties already identified as responsible parties in the case of the accident that killed seven motorcyclists, others may also be determined to be responsible as the investigation moves forward.

By way of example, there may have been some sort of malfunction in the truck that contributed to the accident in some way. If that happened, other potentially responsible parties might include the truck manufacturer, a parts manufacturer, or even a party that was responsible for providing maintenance on the vehicle.

In addition, public investigators will only go so far when it comes to identifying responsible parties in the case of this horrific accident and others like it. Thus, a person involved in this type of accident oftentimes needs to turn to an experienced motorcycle accident injury lawyer to ensure that all responsible parties are brought to justice.
