More Late Model Luxury Imports Are Being Recalled

|

With the amount of news coverage being devoted to the emergence of the Coronavirus and to the 2020 elections, consumers may be unaware that over one-half million luxury imported SUVs and sedans are being recalled due to concerns that they are at risk of catching fire even though they were not involved in accidents.

  • On February 27th, Kia announced it was recalling 140,000 of its 2013-2014 model year Optima midsize cars and 51,000 of its 2011 and 2012 Sedona minivans. The Optima recall is due to a defective fuel hose that could develop a leak and potentially lead to a fire, while the Sedona recall is to fix a problem with the fuel injector mounting rail that could also lead to a fuel leak and fire.
  • On February 28th Porsche announced that it was recalling over 70,000 of its 2015-2018 model year Macan SUVs over concerns that an improperly-fitting fuel pump service cover could damage the fuel pump itself and lead to a fire.
  • On November 15th of last year Nissan announced that it was recalling over 400,000 of its Nissan Murano SUVs, Maxima sedans, and its Infiniti QX60 and Nissan Pathfinder SUVs due to a problem with a leaking brake fluid seal that could potentially lead to a fire, even after the vehicle has been shut down and parked.

So far, there have been no reports of serious injury due to fires involving any of the recalled vehicles. However, if an injury does occur as a result of a vehicle fire, who is liable for the consequences of such a fire?

According to the auto accident injury lawyer at The Doan Law Firm, any vehicle fire that does not involve a traffic accident or deliberate, negligent behavior on the part of the driver and/or passengers is presumed to be caused by some defect in the vehicle itself. These defects may be due to problems with the vehicle was assembled or due to defective parts that were manufactured by suppliers and subcontractors. In fact, even if a vehicle accident results in a fire, it is often possible for an experienced auto accident injury lawyer to show that such a fire was due to some defect in the vehicle itself or in one of the hundreds of parts that go into modern automobiles and trucks.
